Parties and application context
In this document, “we”, “us” and “our” means MCT Automotive Group
Pty Ltd ACN 636 285 017, trading under or using the Loans4uS brand, in its capacity as Authorised Credit
Representative Number 536785 of Finance Ezy.
You should read this document before submitting or progressing a finance-related enquiry or
application.
By confirming your agreement to this document in the application process, including by electronic
checkbox, button, signature, or other acknowledgement, you give the acknowledgements, authorisations, and
consents set out below, to the extent relevant to your application or proposed role as borrower,
co-borrower, guarantor, proposed guarantor, or related applicant.
Definitions
In this document:
Credit Provider Schedule means the schedule of credit providers set out in the
Loans4uS Credit Privacy and Credit Reporting
Statement.
credit-related information has the meaning given in the Loans4uS Credit Privacy and
Credit Reporting Statement.
credit reporting body has the meaning given in the Loans4uS Credit Privacy and Credit
Reporting Statement.
Finance Ezy means Finance Ezy Pty Ltd ACN 108 225 841, Australian Credit Licence Number
392182.
MCT Group Privacy Policy means the MCT Group Privacy Policy that applies generally to
MCT Group websites and services, as available at:
https://www.mctgroup.com.au/privacy-policy/.
Privacy Act means the Privacy Act 1988 (Cth).
relevant credit providers means credit providers to whom your finance-related enquiry
or application may be submitted, including credit providers listed in the Credit Provider Schedule.
related applicant includes a co-applicant, borrower, co-borrower, guarantor, proposed
guarantor, or any other person whose information is relevant to the finance-related enquiry or
application.
you means the individual giving the authorisations and consents in this document,
including an applicant, co-applicant, borrower, co-borrower, guarantor, proposed guarantor, or related
applicant.
Credit reporting and credit provider authorisation
You authorise us, Finance Ezy, and relevant credit providers to obtain, use, and disclose personal
information and credit-related information about you for the purposes of assessing, verifying, submitting,
arranging, or progressing your finance-related enquiry or application.
This may include obtaining credit reports from credit reporting bodies, exchanging information with
credit providers, verifying your identity and financial situation, assessing your creditworthiness,
assessing any proposed guarantor arrangement, and arranging finance or related insurance products.
Information that may be disclosed to credit reporting bodies
Relevant credit providers may disclose information to a credit reporting body, including information
that identifies you, information that you have applied for credit and the amount of credit, information
that a credit provider is or was a current credit provider to you, repayment history information, overdue
payment information, serious credit infringement information, advice that payments are no longer overdue,
and information about the type of credit account and credit limits, to the extent permitted by law.
Commercial credit information
Where relevant, you authorise relevant credit providers to obtain information about your commercial
activities or commercial creditworthiness from a business that provides commercial creditworthiness
information, including for the purpose of assessing an application for personal credit or commercial
credit.
Exchange with other credit providers
You authorise relevant credit providers to give to, and obtain from, other credit providers information
about your personal or commercial credit arrangements for purposes including assessing your finance
application, assessing your creditworthiness, collecting overdue payments, notifying defaults, and
otherwise assessing credit standing, credit history, or credit capacity to the extent permitted by the
Privacy Act and other applicable laws.
Guarantors and related applicants
If a guarantor or potential guarantor is involved, you authorise disclosure of relevant personal
information and credit-related information to that person for the purpose of considering whether to act as
guarantor or offer property as security. If you are a guarantor or proposed guarantor, you authorise
relevant credit providers to obtain and use credit reporting information about you to assess whether to
accept you as guarantor.
Authorisation for us to act and assist
You authorise us to obtain, use, and disclose reports and information about your consumer or commercial
creditworthiness from credit reporting bodies, commercial credit reporting businesses, credit providers,
and other relevant persons in connection with your finance-related enquiry or application.
You authorise us to pass those reports and information to relevant credit providers and other persons
involved in arranging finance, and to give to, and receive from, those persons such personal information
and credit-related information as may be reasonably necessary to arrange or progress your application.
Ongoing assistance after finance is provided
You may separately authorise us to obtain information from the relevant credit provider about your
finance after it is provided, for the purposes of assisting you to understand and meet your obligations,
advising you regarding finance requirements, and ascertaining any amount required to be paid to the credit
provider.
This authority is optional. If you do not give this authority, or later withdraw it, we may be limited
in the assistance we can provide to you after finance is arranged, but that will not of itself prevent us
from assessing, submitting, or progressing your finance-related enquiry or application.
If given, this authority continues for the duration of the relevant finance arrangement unless and
until you revoke it by notice to us and, where applicable, to the relevant credit provider.
Electronic communications
If you provide us with an email address or mobile phone number, you consent to us using those details
to send you, or make available to you, notices and relevant documents electronically, including documents
from us, Finance Ezy, a credit provider, insurer, or other person involved in the finance-related process,
where permitted by law.
You are responsible for maintaining appropriate software, hardware, and processes to receive, access,
review, print, and save copies of electronic documents.
You should regularly check the electronic communication channels you provide to us. If your contact
details change, you must promptly notify us.
You may withdraw your consent to electronic communications by contacting us on 1300 509 075 or at
[email protected]. If you withdraw this
consent, this may affect how documents and notices are provided to you.
Relationship with privacy documents
These authorisations and consents should be read together with the
MCT Group Privacy
Policy and the Loans4uS Credit Privacy and
Credit Reporting Statement.
The collection, holding, use, and disclosure of personal information and credit-related information in
connection with finance-related enquiries and applications is described in the Loans4uS Credit Privacy and
Credit Reporting Statement.
If there is any inconsistency in relation to a finance-specific authorisation or consent, the more
specific finance-related authorisation or consent applies to the extent of the inconsistency, subject to
applicable law.
